Hi, my first time posting, so apologies in advance if not making any sense and very long winded.
Last week I was driving along one of the busy main roads In my hometown, which the speed limit is 40mph so was probably doing just that - quite certain as there is a speed camera a few metres down from where incident happened. There are houses to the left of the road and quite busy junction opposite location of incident.. An elderly man (Well In his 80's) pulled out of his driveway in front of me (travelling around 40mph ) trying to turn right to join traffic on other side of road. I admittedly was concentrating on the junction on the opposite side of the road as a car was fast approaching Indicating left to join my side of the road, which thankfully she didn't. So I didn't notice the man coming out of his driveway and wasn't expecting it, so as I was going at quite a speed. It resulted in him turning right Into me, causing quite an impact, causing significant damage to the passenger side and front left side of my car, (resulting in it being a write off). I was obviously very shocked and dazed, in the middle of this busy main road, where the man was knocking on my car window shouting at me telling me I need to straighten up and move my car to the junction opposite as to not cause another accident - which I did. The man that crashed into me then came over to talk to me. He kept saying, "I seen you flash your lights for me to come out, I seen you flash, I looked to left seen that was clear so came out without checking my right again, I didn't think to".
I 100% did not flash to him, why would I flash him to come out? when I was concerned about a car the opposite side of the road, pulling up fast, thinking they were going to pull out? Also why would I still be travelling at 35mph at least if i had given someone a signal to pull out. The lady that was in the car at the junction then came over to see if everything was ok, the man asked her if she had seen me flash, her replying being no - if I had I would've pulled out too. It was a bright sunny day, clear driving conditions. He may have seen some dazzle but it most definitely was not from me. I didn't manage to get this ladies name as she had to rush off, but a lady driving behind me at the time, passed on her details and also informed that she had a dash cam, if needed..
Now today, I have heard off my insurance company who are saying that his insurance company are not willing to admit liability, they want us to do a 50/50 because of him saying that I flashed my lights at him..i have refused this as I really don't think that I am at fault whatsoever..but now worried as it'll be my word against his, as the dash cam footage would be from behind, so wouldn't be able to show that I did not flash my lights. Am I right in believing that I should not take part responsibility? One reason being I did not flash my lights at him, but if i had as he says, it's down to him to look right again just to make sure its safe and clear to pull out? I'm worrying myself silly over it..
