WING MIRROR ACCIDENT (Not my fault)

Hi All,

So last week i was driving and a driver came round the corner (over in my half of the road) and knocked my wing mirror completely off (glass etc still ok) but his exploded and was worse off. I stopped immediately and he stopped half way up the road and he said ''50/50 then yeah?'' to which i said no, as it wasn't my fault and he was clearly speeding also, we exchanged details and i thought that was that as i know mine would only be £30/£40 to fix.

So i ended up receiving a letter in the post stating he had contacted my insurance and after speaking to them it turned out we were both with the SAME insurance company, she said i shouldn't hear anything else and that would be that. I then ended up getting a call yesterday and was told his car was being fixed in the garage that day and the insurance company had decided to go 50/50 on this (WITHOUT speaking to me may i add) so i am now losing 18 YEARS NO CLAIMS BONUS!!!.

They will not give me any information all i know is his damage is £200-£400. They have said because there are no witnesses and no proof that is is 50/50 even though his damage is worse and mine completely outweighed the cost of losing my no claims and his access was also higher than mine.

Can anyone give me any advice as to where i stand? it seems like the company have settled and done whats best for them as a company and not had my interests at hand

Many thanks
