MY son was in an accident 6 months or so ago. There was very little damage to either vehicle but it had all the hallmarks of a "crash for cash" (not least the other driver and passengers suggesting cash settlement at the scene). My son did all the right stuff, called the police etc. He hasn't claimed against the other driver as he has a rather old 1980s car (MX5) that is likely to be written off at the hint of a claim and damage was very minimal dent/scuff. The other driver has claimed against my sons insurance for equally minor damage (for the princely sum of £100 ish ) . My sons insurance has reviewed everything and is refusing to pay the claim as they believe it was not my sons fault however this has had the problem of giving my son no "no claims discount" which is making the insurance more than he can afford. It all seems to be at an impasse and means that my son isn't on the road cos he cant renew insurance. It all seems so petty at the mo and I suspect it isn't helping that the other party isn't dropping their claim as it's not affecting their ability to drive so they "might as well keep going" despite the small sum. Anyway... thats the long story and the point here is does anyone think there might be a way to force the situation, counter claim in some way? Attempting to sue the other party in some way? Despite a helpful and friendly insurance company it's really causing a problem for my son.
