I was involved in a car accident at the beginning of October 2014 where a 'lady' drove straight into the back of me whilst i was stationary, pushing me into a stationary lorry, now she is making out that i had already crashed!?!
To explain it better, what happened was a ambulance was approaching and me and the cars in front stopped (as it was weaving in and out of traffic), i watched as the ambulance approached and came past, within seconds she hit me straight from behind with no attempt to brake on a 50mph road, pushing me into the lorry in front. The bang was so loud that the ambulance that had driven past and was half way up the road heard it and turned around.
luckily my 3 month old in the back was ok and my partner 'only' got whiplash. she admitted straight away that she weren't paying attention and she couldn't understand why we were all stationary?! maybe if she opened her eyes and had seen the massive yellow and green ambulance with a flashing blue lights with sirens blearing she might of stopped.
anyway, after annoying everyone at the scene (ambulance crews, 5 police officers) acting dumb and moaning that she wanted some ice, she sodded off leaving my pride and joy in a serious state.
next morning i ring her insurance thinking its going to be straight forward, they tell me i was to blame for already crashing and they won't pay for my front end damage, they also won't be admitting liability.
fast forward a week and much negotiating with the engineer he agrees not to write the car off. Churchill (her insurance) contact my insurance (Hastings) asking for a breakdown of costs for the front of the car and the back.
BMW who are dealing with the repairs are telling me that if they are doing that they are basically admitting liability. However hastings (serious rubbish all the way through this) say i still have to pay my excess.
I'm really confused? no insurance company has bothered contacting the lorry driver to see how many impacts he felt, they haven't bothered asking for statements from the ambulance crew who saw me stationary.. and she has decided to lie, putting me £620 (my excess).
why are churchill asking to see the bill for the front? how long does this usually take?
