I recently bought a car for £4990 and the day after purchase took it to a garage as I realized it was pulling to one side. I asked the guy at the garage to give it a quick look over whilst he fixed the problem and he ended up giving me a huge list of structural damage to the car and said 'I was surprised you even managed to drive it here without it breaking down'. He said the car was definitely not road worthy, was a write off and would cost over £1000 to repair.
I found the car on an auto trader advert being advertised by an auction house. I paid the reserve price for the car and did not buy it during an actual auction. I was told the car was a Category N car which means no structural damage which is definitely not the case.
I have repeatedly contacted the auction house asking for a refund as the car is not fit for purpose but they refuse as the receipt says 'Sold as seen with all, if any faults' and they say they sell the cars for other people and just take a cut of that.
After failing to get a chargeback from the bank as it says 'Sold as seen', I was wondering if it is worth going to small claims court with the issue?
