Any help would be appreciated.
A couple of days ago, I had a small accident. Nothing major but there was some damage done to my car and therefore I wonder what options I have.
I came to a blind T-junction looking to turn left. Unfortunately due to a house on my right I had zero view of any coming traffic. I slowly crept out inch by inch and then finally saw an oncoming vehicle. I instantly broke and became stationary expecting the driver to slow down and let me out as the car was still some distance away. To my amazement the lady didn't stop but continued forward at a reduced speed thinking she could squeeze through the gap. Due to oncoming traffic "she panicked" (quote) and ended up hitting and scratching/cracking my bumper.
It's a shame to say, that this was a young girl and however much I wish it hadn't happened it did. She said she was unable to slow down due to not being able to change down to first gear. I can only presume she was a new driver.
In addition to this there was a witness who saw the entire accident and he was 100% in agreement that she could have and should have slowed and stopped. Not forgetting the fact that I stopped as soon as I saw the oncoming vehicle but from an oncoming vehicles perspective she would have seen my bonnet creeping out for while.
My worry is "who would the insurance company find at fault?'..., I appreciate I was pulling out into a road, although I did everything I could to the book. I've never had an accident and I've been driving for over 18yrs.
