Give way - Who's to say ? Give way to oncoming vehicles

In many places in the UK there have been announcements of the new powers that will see £130 FPNs being given out to motorists for "Moving Traffic Contraventions (MTCs)"

While all the other "contraventions" are definitive, ie No Right Turn, the "Give way to oncoming vehicles" can often be a judgement call made in a split second, by the driver.

However, someone may be sitting watching CCTV, and they will consider that you didn't "Give way" and issue you a FPN for a MTC. Who is to say who is right?

Unfortunately, you will have to argue the case or pay up, like a great many others have, all over the country where this is already being enforced.

I've tried at length to find any guidelines on the "rules" but there seem to be none that offer any advice. We all know "Might is Right" so would give way to an oncoming LGV, but at what distance has the oncoming vehicle got the "right of way"?
