On the 30th July I brought a mini from a local dealer. Within a day I discovered a fault on the car and returned it to the dealer, who pays for the repair is yet to be decided. The issue I have is that on Monday I was going through old receipt for vrious repairs/MOT etc when I came across a piece of paper from BMW Dealer Stratstone stating that the car, which at that time had private plates on it, had been Cat D on the 3 May 2015. The paperwork also stated the name of the dealership on it. I am somewhat annoyed that the dealer at no time throughout the sale process made me aware of the Cat D. No other paperwork had this on it and there was nothing on the car itself. When I was looking at the car I noted that its general condition was immaculate for its year, 03 plate, and the sales rep mentioned that there was more details on the web site. On looking at the web site we couldn't find the exact car but one with same price and spec but with stripes down the bonnet. When this was pointed out to the rep he said that they had removed the stripes and that was the same car. I noted that there was no stone chippings on the bonnet to which he said that it had been highly polished after the stripes were taken off. I am absolutely seething and feel that I have been mis-sold the car having not been informed about the Cat D. I have done a little homework and now know that the dealership has a legal obligation to reveal everything he knows about the car including Cat D. I am now waiting for the deal to come back to me about the repair, then I will present the receipt to him and ask why I wasn't informed about the Cat D. The price I paid for the car was about average compared what others were charging but now gather that it should have at least been reduced to reflect Cat D. I now know that I could go down the route of taking civil action under consumer protection laws. Any advice?
