Searching around for scenarios this seems to be an active forum where advice / common sense rules on accident scenarios... So I thought I would turn to you lot for some advice after my wife had an accident earlier this week... Neither of us have ever had an accident before (both been driving for 17-18 years) so we have no idea what to expect!
1) The other person is claiming she was at fault.
2) The insurance company has been informed (straight away by my wife, they then contacted the other person as both parties use the same insurance company who hadn't reported anything at that point).
The scenario played out as below (no witness/police involvement or CCTV around):
- Rural road but near a school so 30mph zone
- Travelling at 30mph on the main road
- Private road on left with dashed lines to indicate priority, other car approaching the turning to the main road intending to turn left
- The approach to the private road is a right turn in a shallow U shape, both ways are visible from the turning though, it is at the apex of the U if you like
- As she approaches the entrance to private road travelling on the main road she realizes other car is not stopping and then swerves to avoid being hit, crossing over the central line in the main road as a result.
- It's only a scrape. Damage to cars: On other car front drivers side bumper. On wife's rear passenger side small dent and scraped from the back of the rear door (3 door vehicle) to wheel arch. Paint transfer of other vehicle onto wife's car.
Other car claims wife was speeding and on the wrong side of the road as she turned the corner and that they were already established on the road. No skid marks were at scene to indicate there was any evasive action, or where in the road the impact was. Both took details and went separate ways.
I suspect from reading around as there is no real "evidence" the insurance company will probably suggest a 50/50 even though the other car hit and the damage clearly indicated this? If this happens should we push back for more blame on the other party? if the other party is adamant what will the insurer do?
