hi i need some advice on whether i should argue with my insurance company.
i had just pulled out from a car park space next to a 2 lane road. i checked behind me the whole time by looking in my wing mirror with my right indicator on and pulled out when the road was clear..no oncoming traffic or traffic signalling to move from lane 2 into lane 1 (i was pulling into lane 1). As iv moved out im pretty much fully in lane apart from my back passenger side wheel still coming out of the space. I obviously havent picked up speed yet as im moving off. A car that is in lane 2 decides to pull into my lane just infront of me but to early, the side of his car from halfway across his passenger side door to his rear wheel scrapes across my drivers side bumper. Now my insurer said it will probably be my fault as i was moving out from a parked space but my problem is that the lane i moved in to was clear/no traffic, i didnt pull out in front of him, hes pulled out in front of me and hes collided with my car after it has left the parking space because he has pulled from lane 2 to lane 1 without looking at what is next to him, i think he was just looking ahead and not to the side of him. He only put his signal on as he moved, so i had no indication he was about to pull into the traffic free lane i had just entered. What do you guys think? The way i see it is that nothing i could have done differently would have avoided the collision but he could have.
