Hi! New to the forums here, though I must say, I've been reading through some stuff and it's very helpful.
I wanted to put this in the Insurance section but for some reason it's not letting me post this there!
So, I very recently was involved in a minor collision with a BMW - 'taxi driver'.
It is difficult to figure out who is at fault due to the nature of the situation.
I live in north London. We have a lot of small country roads here.
Basically, we both clipped each others' drivers wing mirrors going down a narrow part of a road. My entire wing mirror is quite literally hanging by a thread, while his only sustained damage to the actual mirror itself - that is, the backing is fine, just the actual mirror was hanging off a bit.
The road it occured on was a road that, initially, when first driven in to, fits only one car comfortably, then has little 'dips' where the width of the road widens for about 30ft, then comes back in again to it's original less wider size, then back out etc.
These 'dips', in this instance, were on my side of the road.
The road is on a hill.
In this instance, I was driving up and he was driving down.
I had just turned into it and was going at a normal speed. I was at the 'skinny' part of the road. I saw his car coming down and accelerated slightly (still within 30mph) in order to try to pull into the wider section of the road, which was at a very short distance in front.
He didn't appear to slow down at all. He drove down and, as I hadn't yet pulled into the wider bit of the road, our wing mirrors hit.
He's claiming that I'm the one at fault, as I should've 'waited' - essentially stopped-for him to pass. However....that wouldn't have made any sense, as the road isn't wide at the point I was at when we collided. If I had waited, he still would've gone in to me.
I go down and up that road almost every day. If that were me, I would've either -
-- slowed down/waited for the car coming up the hill to have gone into the wider bit of road
OR
--it's not the 'done' thing, but, as the pavement are very flat around that area, I would've possibly driven slightly onto the pavement, effectively widening the 'gap' between us.
Can anyone give me their opinion? I think the fact that I'm coming UP a hill and am on the only side where the road widens, means he should've waited for me. Or at least slowed down.
Interested to hear other thoughts.
Also, he's saying the mirror will cost '£300-£500' and that he'll find out how much it is, send me the invoice and I can either pay it (I'll obviously invoice him too) or we can go through the insurance.
I'm not too sure. £300 is rather a lot for a mirror. Wondering if it's worth insurance gong up a bit.
