Hi all, apologies for this being my first post here and straight away requesting advice.
I had a minor accident on Monday night where a car pulled out of a side street turning right and hit me in my passenger side rear quarter. The road in question does not have any speed limit signs but is well lit and also has speed humps so I am of the assumption that this road is a 20mph, possibly a 30mph, speed limit. Either way I was doing approximately 20mph as I had just come round a sharp bend that people on the other side of the road often take wide into the other lane and then I had passed over some speed bumps located right before the junction.
The other driver on the night admitted liability but I had no witnesses and I believe he has now changed it to 50/50. I had to prompt him yesterday evening to get in touch with his insurance company as he had not done so until then.
Am I of the right opinion that he is at fault even if he tries to claim I was speeding? After all I don't see how he could say I was speeding and then continue to justify that pulling out of the junction was his best option. If it came to people having to investigate the damage to vehicles and the junction I feel I would win as the damage is fairly minimal suggesting a low speed collision and the junction is fairly clear and there were no parked cars.
I have also put my repairs and hire car on hold until I find out his opinion of liability from my insurance as I don't want to spend money covering my excesses if he is somehow going to get it signed off as 50/50.
