Hi, I will try to keep this short.
As i was following a car onto a roundabout, (past a green light turning amber) he immediately stopped really hard thinking the other (red) traffic was for him, when it was actually for the people already on the roundabout. as i result i braked and swerved, hitting him on his back corner (at roughly 5mph). He claims it is my fault, but after telling him he stopped for the wrong traffic light he became quiet. it didnt really help the fact that he could not speak english.
Here is the problem: as i have ultimately hit him insurance will see it as my fault regardless, but wont the fact that he stopped in the middle of the road in error account for much of the liability? I have read somewhere that if he vehicle in front braked for no apparent reason, it may not be a strict liability.
So am i still looking at fault claim, or a 50/50?
