I just wanted some advice (and maybe a slight vent!)
I was approaching a roundabout where it is clearly marked that the left hand lane was left and straight over and the right hand lane was straight over and right, on exiting the second exit (straight over) I was hit in the passenger real panel by the third party.
When she got out she said she was going straight over like myself and that she had exited the roundabout in my lane as I shouldn't have been going right in my lane not straight on - after explaining to her and her passenger she changed her story on speaking to the police (I had called them to attend)
She was now saying she was taking the 3rd exit (right) yet she was in the left hand lane (she admits being in this lane also) although she is saying that I "cut her up" and pulled out on front of her to take my exit - 1. If she was in the right lane she wouldn't have been cut up 2. the damage to her car is on the driver side wheel arch so surely if her version of the story was correct the damage would be to her front bumper where there is no damage - okay if we were parallel to each other but as the damage is to the rear panel of my car does this not show I was ahead of her on the roundabout ?
Anyway on ringing my insurance and expecting them to fully agree with my opinion that I am 100% not at fault they said it's 50:50!!
1. She changed her story (granted I have no proof of this)
2. The story she has given does not match the damage on the cars (although insurance seem to think this doesn't matter and I quote "well because it's a roundabout the damage could be anywhere on the car"?!?)
3. In her story she was in the wrong lane to turn right and that's why to accident happened so why am I being seen as at fault at all ? This is also stated in the police report !
4. I was ahead of her and was already half way off the roundabout and indicating to take my exit after we'd past the first exit surely she this is enough for her to realise she was about to hit me ?
Insurance have said I was partially to blame because even though it was a two lane entrance and exit and even though the road markings tell me I am able to take the second exit in the right hand lane I should have kept driving round the roundabout in the right hand lane until the left hand lane was clear and then took the exit JUST INCASE a car in the left hand lane is in the wrong lane ! Something to do with me having to cross the left hand lane to reach the exit
How can this even be ? I didn't think I needed to give way to the left hand lane because I presumed they had the ability to read a road marking and understand what the highway code says about lanes and roundabouts ! I am so mad and frustrated it feels because they heard the word roundabout they automatically say 50:50 without bothering to look at the facts
