I was involved in an accident in Febuary where an 85 year old driver on the wrong side of the road hit me, even though I had mounted the nearside pavement to avoid her! At the scene she admitted liability, I called the police and she admitted to them that this was the 3rd accident she had had in as many weeks and they told her she should not be driving and she should inform the DVLA. There was also a witness who verifies it was not my fault. The other party settled the claim on a no fault basis, my car was written off, I got a full payout and was not charged my excess (as it was no fault) I had a hire car and I received compensation form the other ladies insurance. End of story, or so you would think!
Yesterday I had a letter from the other ladies insurance threatening me with all sorts of actions if I didn't pay the outstanding amount (no amount stated!) and to get in touch with my insurers. I did that and my insurers are saying they are now disputing liability. How can they do this? Surely by paying compensation they accepted liability? My insurance company said that they would talk to them, but they have nothing to loose, the only one who is going to loose out is me! Will they try and charge me my excess? Will they try to reclaim my compensation? Wll I lose my 13 years no claims bonus? (I know they only take 9 years in to account) My insurance company have said that I need to prove that I was not at fault, I feel I have done this adequately already. The police officers who attended did not file a report and there wasn't any injury (I had a soft tissue injury in my back for which I sought medical help) What do I do?
