Earlier this year my daughter was backing out of her designated parking space at uni and the car slipped (on ice I think) and she hit one of her flatmates cars who was not parked in a marked or designated bay.
Due to her uni commitments it was a couple of days before the guy was in the flat for her to talk to. She didnt have contact details for him at the time and had to come home for a family emergency. She didnt have a chance to talk to him first as he knocked on her door when she returned and had a go at her. She tried to explain that she couldnt get hold of him but he was quite intimidated and belittled by him.
He suggested not going through the insurance which she agreed to. Shes a relatively new driver so thought thats what you did. They agreed to get estimates and she asked him to let her know when the car would be available for her to get someone over to look at it. He didnt tell her but instead took the car to a garage and had it repaired. We were unaware of this until he slipped a garage invoice under her door one night. He knew she was in but didnt knock on the door. We initially thought it was an estimate until she noticed the repair the next day.
We have been back to him saying that we didnt agree the estimate price and we would offer to meet him halfway. He has now said that the garage doesnt do estimate and is getting aggressive saying that the garage needs paying and shes running away from her responsibilities.
She is certainly not running away but is reluctant to pay the amount he has agreed to when she wasnt contacted about the price. The invoice is also not detailed enough for the amount they are asking. It just gives a figure for parts and one for labour.
Any advice as to what we should do? As he didnt agree the estimate price with us who is liable for the bill?
