Hi.
Last night a friend of mine was stopped by police.
The reason was the car had the MOT expired from April 19th. The car is on company and they never let the car papers to drivers so he never knew the MOT was expired.
After stopped him they discoverd he's drunk. He had 0.40 and the limit is 0.35.
They took him to police section, kept him over night and let him go home today around noon. He had his proces on June 4th.
Now, i've seen on GOV.uk.co what can happen with him but there they say it depends how bad was the offence.
What i try to understand is are any chances to make some prison for what's happend last night??
He stopped immediately when the police ask him, was very cooperative and didn't had any incident while drove the car.
I know they will take his driving license for 12 months and he'll need to pay a fine, but the real problem is thoose up to 6 months in prison.
He had the same problem in Romania ( he's from Romania) a few years ago, will count that problem in court??
