my vehicle pulled into the right most parking spot, right next to a moving van which was loading office furniture. everyone left the vehicle but just one last person, who was still in the process of getting out through a rear off-side door (another person had just gotten out through this door a moment earlier). someone of the moving van decided to operate the tail lift which effectively hit my rear off-side door as it was still open for the last person to get out.
i see the whole incident as a moving van at fault. they hold me at fault, as does their insurance. i have a fully comprehensive cover, and will likely have to claim through my insurance.
but the whole thing raised a couple question:
- if i view the facts as not my fault, can i somehow file a claim against the moving van insurance? how do i do that, and what is the actual process?
- if i only had the third party insurance - which i was very much entertaining just a few months ago at renewal - what is the actual process to claim against the third party when my vehicle is damaged and i view it as their fault?
besides a vehicle front glass, i have not dealt with insurance claims in any recent memory, and i would very much value some guidance on the above.
