No Insurance - Commercial Vehicle

I am not a driver but I have am in a company partnership with my husband and we have a couple of vans suitable for different types of deliveries, we only use the big slow one if we have to, it is a necessity.

On a day last month, my husband was away using the big van and my uncle called to see could he use the regular van for a move of a fridge from one location to another, and I asked him did he have insurance. And indeed he said he was covered to drive any vehicle. and as he is my uncle, I took him at his word.

Lol and behold, he is caught speeding (not much) but enough to get a fine and 3 points. and is asked to produce insurance within 7 days at our local police station. and to be honest we give over our documents to show the van is insured and he says he will show his insurance to say he is insured. and we think this is the end of the story.

but it is not, as he was only insured to drive any car but not a commercial vehicle. and so he faces another 6 points and a fine and maybe his licence being removed.

However my husband is led to believe he also may gain points and a fine and is fuming as he has never had either and has built up a good history of no-claims. While risking a family dispute, he also feels badly let down as he never personally gave his permission and feels that it is unfair that this will affect him. He thinks he would have asked to check this and I did not. It was I who gave the permission but I don't drive, I cant get points as I have no licence and technically it is not my van.

Any advice. My uncle's position is lost but what advice for us. In one sense we are very grateful that no accident occured as this would be a catastrophe for all involved.

Big lesson in life for me too for being so trusting. what is done is done but what are the consequences for my husband?
