Car Dealer Criteria

Hi, I`m after some help please. I purchased a car for what i thought was a dealer which went wrong within the first week. He is claiming it was a private sale and sold as seen so I am progressing to court as I have images of the many cars he has had up for sale in the last 3 months.

I have an email from him stating that he is advertising these cars for other dealers and does not actually own them himself. If that is the case, would a judge still class him as a dealer whether he owns the vehicles or not?
