My insurance company flat our refuses to follow my explicit instructions!

So long story short, I was hit from the side/rear at a roundabout in August 2012. There were no independent witnesses so my insurance company, Admiral, suggested settling on a 50/50 basis was the best course of action.

Throughout all ongoing negotiations they continued to say 'it would be best if we settled 50/50.

In November 2012 I stated clearly that I DID NOT want to settle on a 50/50 basis and wanted the case to go to court. From that point onwards until October 2013 there was no further communication from Admiral until their legal team contacted me saying they were responding to legal claims made by the other party and were going to settle on a 50/50 basis.

The legal team is working on a delegated authority meaning Admiral will go by whatever they say.

Since October I have constantly stated I DO NOT want to settle 50/50 but Admiral seem to not care. Their line of reasoning is that it would not be economical (financially beneficial) to go to court and anyway in their T&C's it states they have the final say when it comes to settlement decisions (I'm still looking in to the T&C's to confirm this).

I have threatened to contact the Financial Ombudsman but to no avail. Admiral flat out have refused my request for this case to be heard in court.

I do not know what to do.

Any advice would be helpful at this stage.
