So basically I need some advice in relation to a RTA I had on Monday 13th June 16. I was driving down a main road at a decent speed of 30, where a car pulled out a give way side road to the left of me. I swerved in order to avoid collision with him, there was not enough time to stop. As I swerved his car hit into the paSsenger side of mine and my car swerved and hit another party which was another car from the oncoming traffic on the main road. At the time the guy who hit into my passengers side got out the car and automatically started to blame me and said all this stuff that women can't drive. He had a couple of friends with him who were all saying I was going too fast and it was my fault. I ended up in tears and they finally calmed down. This is my first ever RTA so was in shock and didn't know what to do.
All parties exchanged details. And I rang my insurance company straight away. I'm third party fire and theft insured. They stated from my version of events the guy who pulled out side road is in fault. So they gave my details to enterprise who were goin to give me a credit hire car and repair my vehicle and mine is now unroadworthy. Enterprise then gave me a call to say his not reported the RTA to his insurance as of yet so they will contact him. I assumed because he knew he was at fault. However got a call today from enterprise to say that his insurance and him are disputing the matter. I don't understand how. so now they can't give me a courtesy car nor fix my car.
I rang my insurance company who stated that I could do repairs myself and if liability falls on him then I could get costs refunded. But I have no idea how this works. My insurance company have already spoke to a witness who was in my favor. But how long will this drag on for , what could he had possibly have said to dispute it, he didn't even tell his insurance company till they contacted him. And with the oncoming car that I swerved into will I be liable for that. Because I only swerved into that car due to his actions. It's a crazy one I know but I need to know what's the best way round this. It don't help that I'm third party fire and theft either 😔😔
