In November 2015 I was stood on the pavement looking to the right for traffic , waiting to cross the road, traffic was fairly heavy , a van that I had walked passed some 25m up the road reversed in to me. He was attempting to reverse into a gap between two buildings to turn round. There was a lower curb where I was stood but it was the pavement I was on, same as a drive to a house.He had reversed down againts the flow of the traffic. I had moved down the road to cross as the van blocked my sight line. As the traffic was heavy I had been waiting some 3 or 4 minutes. There are no pedistrian crossings on this section of road.
Apart from cuts and brusies, I have suffered a nagging hip injury which I am now told will require a hip replacement within 3 years and some what now seems to be permenant reduction in neck movement further test required - NHS for wait and see if it clears up. I did report the accident at the time to the Police and I got his details at the time of the accident.
I did not persue any claim againts him at the time, I am not some claim junkie at the time it never really crossed my mind, just oh that hurt and a few free beers at the pub. But months on and facing a hip op and having been in enough pain / restiricted movement to stop me doing things - kids now have to put my socks on. I have made a claim with a Soliciter, not a claims company.
For some reason I feel really bad about claiming, I somehow feel that as I was standing between a gap that is used to get round the back of a building I was at fault, the Soliciter says no but...Thoughts on liability would be appreciated, if I am at fault I would like to know.
The van driver is a local he lives two streets away, it seems that he did'nt inform his insurance compnay at the time, what are his outcomes. I have now heard that his insurance company can admit liability on his behalf due to his failure to report it and that they can recover any payment from him for not disclousing the accident. I really am not in the business of bankrupting somebody...Is that true ?
