Insurance Problems - Not our fault.

Hi all,

My girlfriend has recently been in a car crash, she was stationary on the left side of the road waiting to turn when a car decided to cut the corner driving too fast, drove onto the left side and went straight into her sending her car back 30ft and writing her car off. My girlfriend suffered cuts and bruising from the impact which also set the air bags off and needed medical attention at the scene due to back injury. The police got involved and charge the person with careless driving.

So we tried to claim on the insurance but because my girlfriend doesn't have fully comp (I know silly) only 3rd party so the insurance company are being a pain. So we have tried to make a claim directly to the other persons insurance but they aren't even going to investigate it because the other driver has denied responsibility. The witnesses only saw my girlfriends car getting forced back from the impact, no body actually saw the car drive into her car so that's why they are refusing to look into it. We have given pictures and videos to prove who's fault it is and also the witnesses are on our side.

Has anyone got any advice or know who to contact? We're not going to back down for something that wasn't our fault.
