Hello, I'm new here but would like to ask a few questions please.
I was recently involved in an accident on a major roundabout in Sheffield. The roundabout is a spiral and is clearly marked out. To explain, using a clock face as guide, I was in 12 o'clock position. I'm taking the exit as 9 o'clock, so taking my 3rd exit / right. It is a large roundabout and visibility on the roundabout is very good. I give way, and when safe to do so, I proceed using the correct indication and lame position. I follow the correct spiral effect and after passing 6 o'clock position, I indicate to leave the roundabout. I do not cut lanes and I follow my intended painted exit.
Just before I exit the roundabout, I am smashed in the rear quarter panel by a young girl. She has apparently come from 6 o'clock position, intending to take 12 o'clock exit. I drive to the nearest place that is safe and pull over. Her car is still in the roundabout, but she is able to crawl off the roundabout before it cuts out. I walk over to her car and ask her and passenger to get our, as it is not safe for them to stay in the car. I call the police immediately. The first words to leave her mouth are "I'm sorry, I didn't see you". I said as long as you know you caused the accident, it's fine, accidents happen. She admitted she was at fault, and then proceeded to apologise for the next ten mins until police turned up. Myself and her passenger are asked by police to push her car to a safe place, I oblige and both vehicle are now in the same place. I take photos of both cars, and the police ask what happened. Nobody injured so he says just report it to insurances, he leaves the scene. I call my insurance and they immediately state that it's 50/50. What on earth!!! She has clearly not given way on a major roundabout. The damage to both cars clearly shows that as fact.
She calls for recovery and clearly states to them that she has run into me, yet another admission. My car still drives as the damage is in the rear quarter, so I intend to drive home. We exchange details and I ask if they need anything while waiting for recovery. I offer them money to buy a cup of tea and they decline, so I point out the nearest place to get food/drink/toilet. They are not local, but I am.
Next day, her insurance call me and offer to repair my car and provide me with hire car. I agree and they admit liability 3 times over the phone.
The following day, her insurance call again and withdraw the offer to fix my car. She has now said she was established on the roundabout for 4-5 seconds and that I have run into her. What the hell is going on???
Please can someone help me, I'm so angry about this. How can her insurance do this?
To make things worse, my car was 3 days old with 100 miles on it. I can't believe I was so patient and kind given the circumstances, but that's the kind of person I am.
