Was wondering if anyone has any guideance or knowledge on this please?
I had a head on collision 2 days ago. A foreign (French) driver was using the wrong side of the road. We were on a corner and we collided head on. He admitted blame and has insurance. The car was a French registration and his insurance is also French. (Aviva).
My insurers are stating that I am not eligible for a hire car as the accident was not my fault and its French insurance. If it was a UK driver I would have been eligible for a hire car. (Not a courtesy car as it's likely but not official yet that the car will be declared a write off - theres no front end left)
So I'm left with no car and no way of getting to work.
My insurers have suggested, but not recommended that I can hire a car out of my own pocket and my legal insurance can try and claim for my losses. For me however it's still a risk and I'm out of pocket to the tune of hundreds of pounds for something that was not my fault.
Alternatively I could go and buy another car and hope that everything runs smoothly and I receive a cheque for the write off. I guess I'd need to buy a car regardless to replace my other, but I don't want to buy the first thing available in a rush. Secondly I still need to tax and insure the vehicle which is in a recovery pound at the moment, even though I can't use it. Third, they may well decide to repair it in which case I'll have bought a second car I don't need (this is highly unlikely as the value of the car was around 2k and it really was a mess, both airbags deployed, dash misaligned etc)
Does anyone have any advice or experience in this matter? It would be gratefully received! Feel a bit hard done by really as I didn't do anything wrong and now it looks like it's going to cost me hundreds. Thankfully, I left the car unscathed bar a few bumps and bruises, so that's the bright side!
