I entered a pcp agreement with peugeot on 21/10 this year. It was for a peugeot 108 with delivery mileage. On 29/11 the car broke down on my first return motorway journey (I was going about 50 miles each way).
The speed kept slowing and wouldn't puck up so I started to pull over when it was down to 40 and was just about on the hard shoulder by the time it stopped. There was a burning smell of gas. I managed to turn the car on twice and each time when I went to first gear the clutch would lift all the way up and not move or stall.
I kept my lights and hazards on as it was snowing and low visiblity. The flashing and noise sped up until they stopped so I occasionally used the wipers as I have a dark car and the windows were covered in snow. After the third try the car stopped turning on.
When I was rescued a few hours later I was told there was a smell of the clutch and some kind of electrical fault. The guy could not get the car on to check mileage and the keys would not lock with the fob or manual key or by sitting inside the car.
Peugeot are saying the clutch wear and tear is my fault and I cannot cancel my agreement based on this but can get an independent opinion with dekra which will cost me £195. I've been told by a mechanic friend that is very very unlikely a clutch in a new car can wear out in five weeks even with bad driving.
Citizens advice told me how to send a letter rejecting it but because they responded back and denied and invited me to get an independent report that is my only option.
I'm worried about doing this because I read a bit online and it looks like clutch wear and tear is really hard to prove. Can anyone tell me anything about this? I can't find any guideline time frames for what isn't fair wear and tear or anything and am worried about wasting money in a report.
