Advice re: RTA in August 2015

There may not be specific answer(s) to my post but really I'm just looking for general responses, experiences, advice etc.

I was involved in a non-fault RTA at the end of Aug 2015. I was correctly traveling in the outside/left lane on a large roundabout passing an exit (to take the next exit) when a van driver in the middle lane decided to swerve in to my lane in an attempt to incorrectly take the exit I was passing, if that makes sense. His passenger side front wing collided with my drivers side rear wheel arch area. Damage to my car, no visible damage to theirs. Both pulled up, swapped details, took photos etc. but unfortunately no independent witnesses (I did try but obviously difficult on a roundabout & I don't think people bother stopping much unless it looks really serious!)... Fast forward 3 months, my car has been repaired via Albany Assistance (I'm insured with Hastings Direct) so they're in the process of reclaiming the costs back from the TP. I didn't have a hire car. It's made more complex by the fact it was a company van. Albany were chasing Enterprise and their insurers who hire the van out but it's actually the company who've insured the van so Albany have sorted this and (I believe) are in liaison with the correct insurers now who have responded to say they need to investigate the circumstances... what I do know is that about 2/3 weeks ago when I had this discussion with Albany and they'd figured they were chasing the wrong people, they told me the company hadn't even reported the incident to their insurance!!! Anyway, despite the numerous comprehensive e-mails, diagrams, Google Maps etc. I sent I was asked to complete a form with my version of events and diagrams all on one document which I did so at the moment I'm just waiting for Albany to let me know when they hear back from the TP.


So........... maybe I'm thinking the worst (as I usually do) and am pre-empting the TP are going to try & deny liability or settle is 50/50 and I want to be prepared to fight that if it happens because I did absolutely nothing wrong and also suffered injury because of their inability to be aware of other drivers speeds & position around them!!!

Has anyone been in a similiar situation?

I'm aware I'm already rambling anyway so ask any questions as you see fit as didn't want to make this too long! A few other points - I did try & obtain CCTV but the camera on the roundabout is only a traffic control camera. I received a text from one of the guys occupying the van immediately after the incident so they cannot outright deny it ever happened! This was on Tinsley roundabout in Sheffield for anyone familiar with the area, at the A631/Shepcoat Lane exit... if you know the area well you'll probably know it's bad for people cutting across from the middle lane to try & shove others out of the way to get on to Shepcoat incorrectly!!
