on Oct 16th 2015 my wife's 2010 Hyundai Sante Fe went on fire whilst she was driving it on a busy motorway. Thankfully she got out ok. The vehicle's 5 year warranty expired on 4th Nov 2015. The car has 49K on the clock and was pristine with no previous issues.
I went through my insurance company after the incident as I felt there would be no issue with them covering the problem. The insurer performed a fire forensics report on the car and deemed that the fire started due to an issue with the automatic gearbox which ejected transmission oil which then went on fire causing fire damage to the wiring loom, ABS pump and loom amongst other things!
The insurer said that due to the fire starting due to a mechanical problem they would not cover it. Obviously I was gobsmacked by this but they do have an exception (as I believe do all insurers) around mechanical problems and them paying out.
So following on from this I reported the issue to Hyundai on 5th Nov (date was completely by chance BTW). They have come back with the following:
"As promised during our recent telephone conversation. I can confirm that your vehicles warranty ended on 4th November 2015 and your reported this matter to us on 5th November 2015. As with any warranty there is a start and end date, and our warranty team cannot backdate a claim so this matter would be chargeable to yourself as the vehicle owner."
I find this totally unbelievable as the incident occurred on 16th Oct and I can prove it through fire brigade and police reports.
What do I do next?! We basically have a car that is a CAT B write off and have been left high and dry by both Hyundai and (to a lesser extent) the insurer.
Any advise would be very welcome!
