Hello - I've recently sold my car on a well known auction site and the car was advertised as not having MOT or tax so it was stated that the new owner would need to come and collect with a trailer. The advert also stated the car had been on the drive for many months and although has been started form time to time to keep it running the brakes may not be fully functional.
The person who has bought it wants to come and drive the car away but they say as they are French (they want to come by train from Paris) they do not need to have an MOT to tax to take it out of the country. I'm really not very comfortable with this arrangement as I'm wondering if I'm still legally liable for the car until the DVLA agree to transfer ownership of the vehicle, which could take time? Surely its not legal on the road without a valid MOT or tax even if they say they are insured. If they drive overseas for an MOT in France, is this allowed? What if the car broke down on the way? Can I state that the purchaser must come and get it on a trailer as stated on the advert?
