Lorry ran into the back of me, when checked, my insurance ran out the day before?

Hi, Got a very quick question. My wife was hit by a lorry as she was in statuary traffic, not a lot of damage but boot will need replacing, my wife got all the blokes details and he agreed it was his fault. When I checked our insurance it had ran out the day before, we wrongly thought it would automatically renew,

How do we stand, will the other insurance of the lorry still pay out?
We are ringing today to renew the insurance and inform the insurer what has happened.
