Hope this is the correct forum (posted in INSURANCE also) For legal purposes I live in (and accident happened in) Scotland. My parked car was written off by uninsured driver in a stolen car. I accepted write off and received settlement from my insurers.
My point is that my settlement was far less than I paid for the car, a 09 reg VW Golf. I paid £12,000 for it when it was 1 year old. I have now bought another VW Golf, again 1 year old, for exactly the same price. Is there any way I can claim against the uninsured driver for the difference in my insurance settlement and the value of my new car (approx £4,500)??
I obviously did not want to buy a 6yr old car as a replacement, and had been considering a trade in of the vehicle that was destroyed, later this year. I spent several thousands of my own money to buy 'like for like' (in my mind anyway) but at a time when I would not have chosen to do so.
Any advice gratefully received.
