Think I posted this on the wrong thread before, but I could do with some advice.
On Saturday I was reversing out of my driveway, no more than 5mph as I always do as my neighbour always parks on the road not on her driveway. Saw a bike at the top of the road (150 yards away, 20 mph zone) so as I was almost 3/4 out of the drive I continued but still slowly, next thing I know bike hits me at the back, side on.
She jumps off her bike leaving it to fall to the floor, shouting abuse at me about not looking where I was driving.
Torrid of abuse later from her, I pull over and take photos of 3 inch scrape to the right side of her bike and the small scuff mark on my rear bumper, she has walked off down the road (50 yards) to a friends house who joins her (she is still shouting at me).
Her friend suggests that as the damage is little more than paint work, maybe we can sort things out, outside of insurance, after all it will be more trouble than it is worth, realising that I am going to get blamed for this as I was coming out of my drive I agree, as does she, so I give her my phone number and say give me a call when you have a couple of quotes and we will sort something out.
Later I get a call from here to say that she has spoken to her sister who 'Works in the Motor Industry Insurance Trade(sic)' who has advised because she also now has a 'slightly' damaged brake leaver, she now wants to take it to my insurer, again I say to her, is this not a little silly, again the lever will not be much and nor will the paint work (I had already called a couple of places I know and was quoted around £50 - £80 for the paint work and labour).
She starts going on that she knew I had only been driving for less than a year, so she wanted my details, I pointed out to her that I had been driving for over 2 years so I was not sure where she get that information from but it was wrong, so again I say to her, hang on, the cost here will be minimal, get two quotes early next week and we can get this sorted out, go through the insurance and it could take weeks. She backs down a little and says yes, I was right and that she would look at getting quotes on Monday or Tuesday.
Today I get a call from my insurer to say that she was also now claiming bodily injury as well as damage to her helmet and jacket oh, and they are not going to fight it because I was backing out of my drive.
As I did not give my details, how the fracking hell did she get hold of my details to do this, guessing this from her 'Sister' and my number plate.
What can I do about this, I feel I am being fleeced not only by the rider of the bike, but also by my Insurer, as I said I know that legally it is my fault, but come on, should my Insurance company not be on my side?
