I was wondering if anyone could give me an advice regarding an accident I had yesterday.
I was at a petrol station there were pumps either side and a channel in the middle to enter/exit forecourt.
A car was pulled up at the left pump. As i was driving down the middle channel he flung his door wide open a split second before I went past and I hit his car door.
I really do not think there is any way I could have avoided the accident but the insurance company have said that from experience the driver e.g. me is at fault here. I would understand if the door had been open 5-10 seconds but this was not the case and there was literally no time for me to react. Part of the High Way Code 239 - states that when you MUST ensure you do not hit anyone when you open your car door and check for traffic.
I don't believe there was anyway I could have avoided the incident. Anyhow, there is CCTV on the forecourt so that will hopefully help me.
