Accident - opinions please!

Hi,

Sorry this is my first post but was wondering if could get some advice.

I was driving up a road which has 2 lanes both ways. I was approaching a crossroads and was on the left lane. There was a car on the right lane waiting to turn right. I went over the crossing and hit a car coming from the opposite direction who turned right across my path.

He apologised at the time and we exchanged details.

I informed my insurance company who put in a 3rd party claim to his and they've come back saying that that it's split liability as he's told them I changed lane and he therefore didn't see me.

It's a reasonably straight road and I changed lane well before the intersection and indicated. Am i wrong in thinking that this is completely his fault? He simply didn't look carefully enough before turning across traffic.

There's no issue with the traffic light as both lights were green and the right turn is not signal controlled (i,e he can't claim I ran a red light without saying he also did).

I think it very unfair that I have to shoulder any of the blame for this but would appreciate any advice on if it's worth fighting this.
