Whilst turning right in my combi work van when raining heavily a car never seen me indicate and went into the side of my van damaging the back side panel towards the wheel area.the other car is saying I never indicated even though at the time of accident she said I was too close and 10 minutes later said I was doing a u turn. Now because there wasn't any independent witnesses my works solicitors have accepted 50/50 even though I haven't and my union solicitor has said there isn't much I can do for now . Should I ask to go to a small claims court ?
