We bought a car on 20th March with an Mot purchased just 4days before we bought it by the dealer.We checked the oil before I took the car home from the dealer abd there was nearly nothing there,so asked the dealer and he said that when they changed the oil they probably didn't pour wnough in.So they pour around 3 litres in.On the way back home,I've felt like there's something wrong with it.If you wanted to speed up from 50 to 60 it felt quite heavy and was very slow to speed it.So anyway next day I asked my husband to try it.So we took it for a shopping trip,but on the way back the engine management control came up.We safely arrived back home,checked the oil,again not much left.We called the mechanic on monday and he did the diagnostic and it came up with these faults:
Fault codes EGR valve flow restricted. Clutch switch outside normal operating perimeter.
Engine coolant temperature sensor outside normal operating perimeter. The EGR valve flow is restricted because the engine is burning a huge amount of oil,ie 1l per 50 miles.
In his opinion this car could not pass an MOT and is not suitable for use.
So on Tue we pour a litre of oil in just to get it back to dealer,told him what was found by the diagnostic,said we refuse the car and would like our money back. He then said he has to take it for a check up and that he decides what he's going to do. Then it got a bit messed up as we were arguing that they sold us a car which didn't matched the description,got hot and gave us key back that we're not gonna get away with it and can take him to the court.
I would like to ask any advice what we should do. Should we report the car to DVSA,without the option for dealer to make their diagnostic,or leave them to do the diagnostic and if we are not happy with the result then contact the Dvsa?
Slightly confused if we've got any right here or not. Are we allowed to be there when the dealer do the diagnostics.Do you know?
