This is my first post on here and I'm looking for some advice please.
Here's what happened:
In July (7 months ago) I was hit from behind when I slowed and then stopped at a roundabout. It wasn't a safe place to stop to exchange details (very busy middle lane of slip road into roundabout), so I waved to the other driver to follow me, then travelled to the other side of the roundabout and pulled over a little further down the road once there was a hard shoulder to speak with the other driver. We agreed that it was still not a very safe place to stop and he would follow me to a quieter road to exchange details. We did so and the other driver was very pushy - asking me to make a written statement (which I declined to do). He kept shouting that I shouldn't have stopped (there was traffic coming from the right) and claiming that I had caused the accident. I gave no response to this and just asked him for his insurance details. We swapped details and phone numbers and he went on his way. My car was unfit to drive and so I called my insurance company and they sent a local tow company to collect my car and then provided me with a hire car. A few weeks later I'm told by my insurance company (Admiral) that my car is a write off and they are going to give me £3,000 for it. I accept, return the hire car, buy a new car, update insurance details and don't think any more about it.
Last night I receive a phone call from the man who hit me, being quite abusive and telling me that I was trying to extort money from his insurance company. I asked him to contact my insurance company if he wanted to discuss things and then he started shouting at me so I hung up the phone on him. He called 4 more times last night leaving 2 voicemails. He then text me twice saying that I was a 'cheat' and that I was trying to 'extort money'. He also accused me of fleeing the scene of the accident and claimed he had a dashboard camera which he was going to submit to his insurance company to prove this. He was also quite threatening, sending one text that just said 'we'll see what happens now'. I didn't respond to any of this communication.
I phoned Admiral today to let them know about this and they told me that my claim is being disputed and that the other insurance company has made one payment but does not want to make the final payment for my car since it was a category D car. I'm really confused as my insurance company told me this really quickly and I now have no idea what is going on. Surely it was the insurance companies who decided the value that they were going to give me for the car? They're already raised my insurance renewal by about £300 as this claim is still apparently open. Is there anything I'm supposed to do here? What I'm worried about is that they're going to try to claim the money back from me for some reason, despite me not being at fault and being up front that my car was a category D car. Can they do that? And what about this claim that I had fled the scene of the accident? Surely it would be clear by the fact that we stopped and exchanged details that I did not do that...? Gah this has totally stressed me out! And I had thought it was all done and dusted!
