My friends wife was recently in an accident. A motorbike was overtaking a bus on a bend and hit her car as she was driving in the opposite direction. When the police finally arrived at the scene the seargant in charge seized her car even though the accident was not her fault and the motorbike hit her.Several statements were taken and they all said the accident was completely the fault of the motorbike rider, there was no evidence to suggest that either she or the car were at fault Before she could do anything (and she was obviously in shock) a recovery vehicle turned up and her car was towed away. The officer did not provide any documentation and now the police don't even know where the car is. I've been browsing and found that a 165 form should be issued when a car is seized but there is no mention of the right to seize a car that has been"the victim" in an accident. Should the car have been seized at all?
