I was wondering if anyone would be able to help me out with my insurance claim. I was recently involved in a car accident on the M25 motorway. I was moving in slow traffic (I was in second gear, approx 10-15mph) in lane 3 in a 4 lane stretch of motorway. There was a foreign lorry behind me in the lane 2. He either drifted into my lane or didn't see me and thought it was ok to maneuver into my lane. Anyway, as he moved into my lane he collided with the rear left panel of my car and the alloy wheel. My instantaneous reaction was to try and get in front of him to clear him as I did not want to be pushed into lane 4. My back was pushed out and I ended up with my front in front of the lorry and as he stopped I flew through lane 1 into the hard shoulder - I was lucky not to hit anyone in lane 1. There is no damage to the front of my vehicle.
After the collision he left his lorry in the motorway. I did not think take a picture of his position - I am gutted as this would have shown him in between two lanes but the traffic was moving and I assumed it unsafe to try and take a picture - he moved his lorry 5-10 mins later. I questioned him of his error as he tried to reattach my bumper and he said that he "lost attention" or I "left him little room". I spoke to his boss and explained the situation and was told that the lorry driver thought it was my fault! I said to the lorry driver that it must be quite easy to agree who was at fault and he didn't say anything. I am worried that he will lie and say I went into him. I tried to obtain CCTV but I only thought to do this a week after the incident and Motorway Cameras only keep the stills for 7 days (insurance did not think to do this even though I told them no witnesses).
Can anyone offer me advice how this insurance claim will conclude if I go ahead with the claim? Does the fact that he went into the back of me mean he is at fault by definition? I am a young male driver and I am sure it is in my best interest financially to keep my no claims, so if there is any risk of this settling at less than his fault entirely then I will have to pay for the damages myself. Damage is estimated at £1600 but I am sure this is a bit over. When I got out my car I really expected damage on the passenger door as when the lorry was pushing me I looked through the passenger mirror and saw the grill but there is only damage on the rear left panel
