liability dispute after a collision

Hello,

I need some advice so here's my story.

I was behind a car on a 5 lane roundabout at traffic lights. When the lights went green, obviously we all went ahead but the car in front of me began breaking sporadically making me believe he was trying to make me hit the back of him (insurance claim) and he was about 2 hours away from home with a car full of passengers. I decided not to entertain this, indicated right and pulled out to overtake, establishing myself in the 3rd and overtaking lane, before beginning to accelerate onto a duel carriage way - it's 3 lanes that merge into 2 so people can overtake. Next I see him make a sharp right in my peripheral vision (as though he'd realised he was taking the wrong exit) and he smashes into the left rear passenger side of my car causing the car to flip and roll down the duel carriageway before eventually skidding into an embankment.

Once the car stopped, I jumped out and grabbed my 14 month old who was sat in his car seat where the driver had collided with my car.

Cars a write off and was on finance so I have no car and no money to get one. But I wont get into that.

Anyway, being 8 months pregnant at the time with a 14 month old I had people flocking to me but never having been in an accident or even having so much as a speeding fine I was pretty flustered and overwhelmed and didn't get any of the witnesses details.

The driver that hit me DID NOT get out of his car. He didn't even check we were ok. He was approximately 8000 years of age - old asian man.

Police at the scene, me and monkey taken to hospital to be checked immediately for obvious reasons.

Well anyway, the driver that hit me is saying i hit him and my insurance company are saying its likely to be settled on a 50/50 liability split.

BALLS TO THAT. He nearly wiped me and my children out and doesn't have a dot of remorse so why am I being punished for it?

What would you do? I have legal cover included in my policy so is it worth fighting? I'm 22 and stress levels are through the roof with this one! I just can't believe someone could drive so dangerously, nearly kill a young family in a rear collision and not even get out of the car to see if we were ok. Obviously I know the human race are expert liars but it was 100000000000% his fault, quite obviously so and I'm being penalised for it. I don't even drive over 30mph I'm an actual nana when it comes to driving! haha.

Any advice/experience would be greatly appreciated!
