Hi the details of my accident are quite long so I'll try and shorten them as much as possible but I'd really appreciate some help!
I had an accident in July 2013 I was coming off the motorway going downhill on a slip road and the traffic lights were red so I was breaking then all of a sudden a car from my left hand side, inside lane, pulled into my lane, the middle, without any indication so I braked harder then all of a sudden their car cut out. I tried to go into the next lane before hitting their car but couldnt so hit the back of their car...I know if you go into the back of someone that it is 'your fault' however the guy who was driving admitted at the scene there was a fault with his car causing it to cut out..my car ended up being a complete write off and their car got taken away with mine to check for a fault, it was made clear their was a fault with their car.
Whilst we were waiting for the police to come the lady, the passenger in the car I hit, go out of the car and was sat on her mobile and then talking to me making sure I was okay as I was on my own. When the police arrived they called an ambulance as the lady had got back in the car claiming she couldn't move and her neck was hurting loads, the ambulance and fire brigade came incase they needed to cut her out however the guy who was looking after me informed me he was more worried about my arm then her because I had explained that she was out of the car before they had turned up. After the hospital I called my insurance straight away to inform them of the accident and told them about my injury, the next day the insurance called me to tell me that the person I hit had taken full liability because there was a fault with their car. However in February they informed me that they had changed their minds and they wanted to argue it wasn't their fault..is this allowed?
